The Court of Amsterdam has found that back in 2018 SEG has acted for both FC Internazionale and Stefan de Vrij. However, SEG did not inform De Vrij in advance of its own interest in this deal: a commission of € 9.500.000 + a sell-on fee of 7,5%. The Court has rightfully ruled that De Vrij has suffered damages, which must be compensated by SEG. Taking into account interest and costs, the indemnity (currently) amounts to € 5.166.553.
The “De Vrij case” is a milestone in sports law, a new “Bosman case”. For the first time, the role of agents in transactions is scrutinised by a civil court, where conflicts of interest, lack of transparency and disproportionate commission fees are penalised, and an unprecedented indemnity is awarded.
